Improving administrative decision-making processes in Ukraine by ensuring their publicity under martial law

Abstract

The article analyses the key features of the process of improving management decision-making under martial law in Ukraine by ensuring the principle of publicity, in particular, the specifics of the requirements for publicity of the processes of management and disposal of public information in modern Ukraine through the prism of security requirements and interaction with the Armed Forces are studied. It is substantiated that ensuring the principle of publicity in the formation and implementation of management decisions at all levels of public administration is a requirement of the European integration process. Based on the analysis of regulatory legal acts, it is found that organisational, institutional and legal requirements for the activities of public authorities provide for and oblige them to adhere to the principle of publicity in their activities, including when making managerial decisions under martial law. The author analyses and identifies possible restrictions on the disclosure of public information and establishes that such restrictions relate to the issues of Ukraine's defence means and forces, and not to the processes and procedures of managerial decision-making; the public information manager is responsible for the content of information in the decision-making process and is provided for by law. The author analyses and determines that improvement of the decision-making process in Ukraine by ensuring its publicity in times of war is possible through several strategies (digitalisation, control of financing of activities, development of electronic reporting, review and further improvement of algorithms for crisis communication between the population and authorities, development of civil society institutions, in particular, motivation of people to participate in decision-making, development of officials' skills in communicating with the population on the basis of a balanced approach to decision-making). We concluded that Ukraine continues to develop in the context of war on the basis of European approaches to governance, including publicity in decision-making by the authorities
